At the time of death he had been serving an indeterminate sentence, which began on July 27, 2023 for the 1997 murder of his brother Patrick Cyril Thauberger.

Patrick Thauberger disappeared in September of 1997. The case was cold for over 20 years, when Patrick’s remains were discovered in a Saskatchewan field in winter of 2020.

Joseph pleaded not guilty to all charges in March of 2023 and was convicted of second degree murder, and offering an indignity to human remains in July of that year.

After conviction, Justice Janet McMurtry stated “The only conclusion that satisfies all the evidence is the deliberate murder of Patrick by blows to the head and strangulation, dismemberment of the skull and limbs from Patrick’s body, and disposal of the missing body parts, perhaps with a tractor and a discer as the accused told Barbara,”

In a media statement released by Correctional Services Canada, they said that next of kin, police and coroner had been notified as this is their policy.
